Terms of Service

Welcome to Tracklytics. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Service”). By accessing or using Tracklytics, you agree to these Terms in full. If you do not agree to these Terms, please do not use our Service.

1. Eligibility

You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have full power and authority to enter into these Terms.

2. Your Account

  • Registration: To access certain features, you must create an account. Provide accurate, current, and complete information during registration and keep your credentials safe.
  • Security: You are responsible for all activities that occur under your account. Notify us immediately if your account or password is compromised.
  • Account Termination: Tracklytics reserves the right to suspend or terminate your account if you violate these Terms or for any other reason, at our sole discretion.

3. Use of the Service

  • License: Subject to these Terms, Tracklytics grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.
  • Restrictions: You agree not to:
    • Reverse engineer, decompile, or disassemble our code.
    • Interfere with or disrupt the Service or servers.
    • Use the Service for illegal purposes, including copyright infringement, spamming, or distributing malware.
  • Compliance: You are solely responsible for complying with all applicable laws, rules, and regulations related to your use of the Service.

4. Payment & Billing

If you subscribe to a paid plan, you agree to our pricing plan, as published on our Pricing page. Payment is due in advance of access to paid features. All fees are non-refundable except as provided in our Refund Policy (see Refund Policy).

5. Intellectual Property

All content, trademarks, service marks, trade names, logos, graphics, and data (collectively, “Materials”) are owned by Tracklytics or its licensors. Except for a limited license to use the Service, you acquire no rights to our Materials.

6. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you consent to the practices described in that policy.

7. Termination

We may terminate or suspend your account at any time, without notice or liability, if you breach these Terms or for any other reason. Upon termination, your right to use the Service immediately ceases.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. Tracklytics DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tracklytics AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID IN THE PAST SIX (6) MONTHS FOR THE SERVICE.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute will be resolved in the courts located in London, Ontario.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you (e.g., by posting a notice on our homepage). Continued use of the Service after changes means you accept the new Terms.
